A Heartwarming Thanksgiving Story- 1,000 Homes Saved from Foreclosure

1,000 homes have been saved from foreclosure thanks to Affordable Housing Resources, a Nashville-based non-profit. Dorothy Fisher was all smiles this week following a difficult year and a half. She worked as an administrative assistant at Meharry Medical College for 20 years, until the school let her go last summer. After losing her job, she exhausted what little savings she had trying to keep up with her mortgage payments.

At the end of her rope, Fisher reached out to Affordable Housing Resources, a non-profit that helped her fight off foreclosure and keep her home. Affordable Housing Resources announced Fisher was just one of 1,000 Tennessee homeowners the Nashville-based non-profit helped avoid foreclosure.

Fisher is still working to get back on her feet and says, “Being able to keep her home makes the light at the end of the tunnel shine a little brighter.” This year, she will be able to have her family over for Thanksgiving. “Without Affordable Housing, we wouldn’t have a Thanksgiving dinner and I wouldn’t have my granddaughter and my grandson over to enjoy that festivity.”

New York Attorney Agrees to Pay $4 Million for Foreclosure Malpractice

New York foreclosure attorney, Steven Baum has agreed to a $4 million settlement with the New York State Attorney General, Eric Schneiderman, in a suit alleging that his firm and staff mishandled numerous foreclosure cases. Baum’s firm generated the largest number of foreclosure filings in New York from 2007 to 2010. In this three-year span, the firm filed around 100,000 foreclosure proceedings. Schneiderman intends for this case to set the precedent that attorneys and lenders will be held accountable in his district for wrongful mortgage and foreclosure practices.
Some of the malpractices by the Baum Firm included:
• The firm repeatedly claiming the plaintiff to be the holder of the note, when there was no documentation to prove this statement;
• In many cases the firm used a separate company for much of the processing. By use of the separate company, the firm intended to speed up the documentation process in order to file more foreclosures and increase their own profit;
• Employees from the firm often times were not authorized, trained, or certified to sign off on or handle documents they were signing;
• Many times documents were “pre-signed” without ever being read by an attorney.
Even after the settlement Baum still claims no wrong-doing by him or his firm, saying the Attorney General never disclosed a specific case where his firm preceded with foreclosure on a person whose loan was not in default.

Artist Kathryn Clark Creates Quilts to portray our Nation’s Foreclosure Crisis

San Francisco artist, Kathryn Clark has been depicting the effects of the foreclosure crisis by creating her own line of quilts. She has created nine quilts that display neighborhoods from across the country that have been hit the hardest by the housing market crash. An artist at heart, Clark spent more than five years as an urban planner. She began to notice the stories in the news about the foreclosure crisis and began noticing signs in her own neighborhood, which inspired her to depict the economic problems through her work. She chose to express the crisis through quilts because she was able to use older fabrics that were worn and provided a good representation of the distressed neighborhoods.
Clark has created quilts for areas across the country hit hardest by the crash, including: Riverside, CA, Cape Coral, FL., Las Vegas, Modesto, CA., Cleveland, Albuquerque, Atlanta, Detroit, and Phoenix.

Huge WIN for Victims of the Housing Market Crash and Foreclosures

On March 9th 2012, the Florida State Legislative came to the decision to not pass the foreclosure bills that would ultimately speed up the foreclosure process. Increase in Foreclosure Home Sales in Palm Beach County

During the months of July through September 2011, one in four home sales was the result of foreclosures in Palm Beach County. Throughout the State of Florida, average home sales from foreclosures were approximately 19 percent during the third quarter of 2011. In the third quarter of 2010, the statewide average was at about 39 percent. Just before the housing market crash of 2007, the average of foreclosed home sales from preceding years was around five or six percent. The sizeable percentages are commonly credited to the unfair practices from banks during the foreclosure process.
While the percentage of sales of foreclosed homes is increasing in Palm Beach County, the average selling prices on the homes are decreasing. In the third quarter of 2011, the average sale price was $115,082, which is a 15 percent cut from the third quarter of 2010, which was $135,158. This is an extremely low number in comparison to the national average home sale price that was $165,332. RealtyTrac attributes the high percentage of sales as a positive sign for Palm Beach County due to the depreciation of homes that sat idle too long before being sold.

Whistle Blower on Massive Foreclosure Fraud Case Found Dead

Tracy Lawrence, the notary public who initiated the robo-signing fraud indictments was found dead in her Las Vegas home on November 28, 2011 at the age of 43. Authorities are still investigating the exact cause of her death.

At the beginning of November this year, Lawrence came forward and admitted to the Nevada Attorney General’s Office that she notarized 25,000 fraudulent documents for Lender Processing Services, a Florida company used by most major banks to process home repossessions. The documents were filed with the Clark County Recorder’s Office between 2005 and 2008, The Los Angeles Times reported.

Lawrence also accused two loan officers, Gary Trafford and Geraldine Sheppard, who both worked for Lender Processing Services, of allegedly running the massive robo-signing scheme, forging signatures on tens of thousands to millions of default notices nationwide.

Her involvement in the robo-signing scandal left her facing up to one year in jail and a fine of up to $2,000. Speculations of suicide or natural causes are circulating as the cause of her death, but considering her role in the upcoming criminal prosecution of Trafford and Sheppard, her timely death does spark suspicion of a potential homicide.
