‘Hardest Hit’ Federal Funding Money Spent on Luxury Hotel Stays by Florida Officials

Florida officials have come under fire after it was discovered that they were using money from a federal fund meant to help homeowners struggling with finances and facing foreclosure to pay for vacations and luxury hotel stays.

This information was discovered by the Special Inspector General for the Troubled Asset Relief Program. The alleged misuse of funds took place between 2011 and 2016. Officials from the Florida Housing Finance Corp. used money from the Hardest Hit Fund to pay for all costs to attend conferences in Orlando, Miami, Boston, Nashville, and San Diego. While this part may seem appropriate, it was later discovered that only two hours of the total four days charged were related to the Hardest Hit mortgage relief program. The remainder of the time was spent for relaxation and enjoyment.

The expenses totaled $40,000 for what they claimed were “routine meetings” in some of the finest hotels and luxury resorts in Florida, including stays at the Vinoy Renaissance St. Petersburg & Golf Club and the Hyatt Regency in Orlando. The expenses are considered a direct violation of federal regulations in how the relief funds should have been used.

Florida currently has one of the highest rates of foreclosures, as well as highest rates of denying funding from the Hardest Hit Fund to struggling homeowners who need it the most. “Florida has the lowest homeowner admission rate for relief funds offered by the organization, one of the highest withdrawn application rates and has consistently denied homeowners at higher rates than the national average,” according to the Troubled Asset Relief Program (TARP).

Unfortunately, this is the not the first time a misuse of funds has occurred when it comes to The Hardest Hit Fund.  Back in 2017, it was reported that millions of dollars in foreclosure assistance was squandered by government agencies.

The Hardest Hit Fund was created in 2010 by the U.S. Treasury Department. The fund carried $9.6 billion at the time of its creation to help 18 states specifically, including Florida, who were hit hardest by foreclosures during the end of the recession. In Florida, the money is disbursed by the Florida Housing Finance Committee. However, since its creation, Florida has come under scrutiny for how slowly the agency disburses money to homeowners in need. Back in 2015, it was reported that only 20 percent of the applicants who requested relief in Florida were accepted. The national average acceptance rate is about 48 percent. At the same time, money is being used by federal employees for bonuses and vacations.

Stephen Auger, executive director for Florida Housing, was forced to resign in 2016 after an audit showed he allowed the agency to pay for a $52,000 lobster and filet mignon dinner to honor the lenders who worked directly with lower-income borrowers.

All this information was disclosed in an 85-page report from the federal special inspector general. Florida was one of the states that had a “culture of inappropriate spending” of the Hardest Hit funding. Florida Housing charged the fund approximately $18,000, which was the most of any state, just to send their employees to national housing conference that had nothing to do with the fund at all.

Millions of Dollars in Foreclosure Assistance Squandered by State Government Agencies

According to a new report, state agencies “lumped unnecessary expenses into permitted expenses categories, elevating the risk of fraud, waste, abuse and over-payment throughout the (Hardest Hit Fund) program.”

The Hardest Hit Fund was created in 2010 to assist state housing finance agencies help struggling homeowners facing foreclosure.  More than $7.6 billion was designated for low-income homeowners with the Department of Treasury committing an additional $2 billion to the fund last year.

Any expense the state agencies charged to the program were supposed to be essential to easing loan modifications, according to federal guidelines. The investigation and recent report from the Office of the Special Inspector General for the Troubled Asset Relief Program (SIGTARP), found that the 19 housing finance agencies charged $3 million in wasteful and unnecessary spending.

Some of the charges were relatively small, such as TARP gift cards for housing finance employees, balloons and even a TARP piñata. But other charges were unnecessary and extravagant.  Every dollar spent on these items was one less for people desperate to save their homes.

Among the abuses covered in the 2017 SIGTARP audit report for the State of Florida include:

Florida Housing Finance Corporation. At the same time the Florida agency was billing TARP for gifts and $106,774 in bonuses to employees, it was denying TARP relief to homeowners at record rates, according to the report. The agency apparently processed only half the homeowners with incomes under $30,000 who were potentially eligible for loan modifications.

State Passes on Hardest Hit Funds- Florida Homeowners out $250 Million

Floridians fighting to save their homes from foreclosure are losing out on $250 million in mortgage assistance because state officials opted not to apply for additional money from the federal Hardest Hit Fund. The fund was created six years ago to help those states hardest hit by the housing market crash and foreclosure crisis. All of the board members who voted to turn down the assistance were appointed by Governor Rick Scott, a Republican who has opposed federal bailout programs and whose office once pressured the housing agency to limit the time homeowner’s could receive the Hardest Hit help.

Florida Senator Bill Nelson calls the decision “tragic” and has repeatedly blasted state officials for their slowness in spending the $1 billion that Florida originally received.  As of January 1, 2016, the state had spent less than two-thirds of that amount and helped only 25,000 homeowners while rejecting 120,000.

In addition, the federal official who oversees the Treasury’s management of the Hardest Hit Fund has criticized Florida, issuing a report that found the state had “consistently under-performed” other states in the use of the relief money.

Many Florida Homeowners still Underwater as Government Aid Runs Out

Now in its third year, the Hardest Hit Fund in Florida has served only about 15 percent of the 40,000 homeowners who have applied for help. Once this aid runs out, underwater homeowners are left to find adequate employment or continue struggling with mortgages far bigger than the value of their home. Although the Hardest Hit Fund is a federally funded program, each state decides how to use the money. In Florida, state officials have given principal reductions a high priority.

Since unveiling the state’s version of the Hardest Hit Program in 2010, the Florida Housing Finance Corp. has spent $108.8 million in assistance and an additional $25 million on administration and counseling, according to a first-quarter report released last month by the corporation.

Florida’s handling of the federal program has been criticized for focusing on mortgage modifications and interest-rate reductions more than on principal reductions. The country’s five-largest lenders — Bank of America, Wells Fargo, Ally/GMAC, Citi and Chase — agreed to fund the program as part of a settlement related to allegations that they had dealt in illegal mortgage documents. However, according to the Treasury report, only Citi has forgiven the principal of borrowers not in foreclosure.

The Florida program has also managed to serve homeowners who make more than the local median income. Though about 90 percent of the funds have gone to homeowners with annual incomes of $50,000 or less, about two dozen recipients of aid had incomes of at least $90,000 a year, according to the Florida Housing Finance Corp.’s quarterly report.
